The Freedom to Build and the American Dream of Homeownership
July is more than just the heart of summer; it’s a time when we reflect on the freedoms that define our
country. For those of us in the homebuilding industry, one of those freedoms is the ability to build, grow,
and provide homes for families in every corner of our community. It’s the freedom to build a future, not just
for us, but for the next generation.
The American Dream has always included the promise of homeownership: a place to call your own, where
memories are made and legacies begin. But that dream doesn’t happen by chance. It takes vision, hard work,
and most importantly the protection from policies that can quickly turn that dream into an impossibility.
That’s why the work of our Association is so critical. We are the frontline defenders of the freedom to build.
Our collective voice, your voice, ensures that housing remains affordable, attainable, and accessible. Bad
policy, or far-reaching regulation made without industry input, can bring our entire industry to its knees.
That’s not an exaggeration; it’s the reality we are working every day to prevent.
In June, a group of us traveled to Washington, D.C., to meet with South Dakota’s congressional delegation.
We brought forward the challenges and opportunities our builders face, and advocated for smart, forward-
thinking housing policy. It’s these efforts, year-round and on every level, from local building code discussions
to state workforce initiatives that make our Association worth its weight in gold.
In addition to our advocacy work, the Association hosts valuable events that bring members together,
foster collaboration, and strengthen professional relationships. Whether it’s a panel discussion, educational
seminar, or casual social, these gatherings help build the connections that keep our industry strong.
I hope you’ll join us for Family Fun Night on July 22 at the Washington Pavilion, a great opportunity to
relax, connect with fellow members, and celebrate the community we’re building together.

You may picture a charming house
in the suburbs with a white
picket fence, an American flag
outside and loved ones inside, or
a house on some land in the middle
of the country with livestock in the back.
Regardless of the location, homeownership
is a dream many Americans want to achieve. Unfortunately,
homeownership is out of reach for many due to high interest rates,
complicated building regulations, and a permitting process that moves at
a snail’s pace. These problems have made home prices too expensive, slowed
construction, and created a shortage of available homes.
Research by Today’s Homeowner shows that 70 percent of Americans currently can’t afford to buy a home in their
state. In fact, nearly half of U.S. households can’t afford to buy a $250,000 home, according to the National Association
of Home Builders. Record high inflation and high interest rates have crippled the ability to purchase even modestly
priced homes.
Building regulations and lack of affordability have fueled America’s shortage of 4.5 million homes, only further
fueling high prices as demand outpaces growth in the housing market. The solution is easy – build more homes. But
executing that solution proves difficult through rigorous state, local, and federal regulations for things like zoning,
environmental regulations, and permitting delays. In some places, simply obtaining a building permit itself could take
years. We must accelerate the permitting process.
America’s permitting process lags behind that of our allies. A project that may take two years to complete in Italy
or Australia may take seven years in the United States. This significant delay could be detrimental to American
innovation and growth as companies look to build elsewhere. One reason for delay in the U.S. is due to antiquated
technology and review methods – most of these forms are still processed and reviewed on paper. Multiple agencies
review these documents with little to no interactive ability, leading to miscommunication, mistakes, and delays. This
is unacceptable, costly, and a waste of time.
I’m leading legislation to streamline the permitting process by digitizing these reviews, allowing interagency work to
happen simultaneously in one portal. My bill, the ePermit Act, would codify the Trump Administration’s memorandum
to bring the permitting process into the 21st century and could decrease the processing time for projects by 50 percent.
Doing so would unleash investment and construction in our communities, decreasing the housing shortage, lowering
home prices, and bringing the American Dream within reach for more families.
Building more homes and building them fast would do wonders to make homeownership more attainable in this
country. However, federal regulations can still get in the way and create problems for some populations. For example,
there is an issue unique to tribal trust lands that has made it increasingly difficult to own a home for native families.
Bureaucracy within the Bureau of Indian Affairs (BIA) has made it more difficult to process mortgages for property
on tribal trust land. The BIA has failed to review and approve mortgages in a timely manner, often disregarding its
own timelines established in the BIA Mortgage Handbook. I am leading the Tribal Trust Land Homeownership Act to
ensure the BIA processes these mortgages in a timely manner.
We must cut bureaucratic red tape and streamline the permitting process to give America the freedom to build again.
By increasing efficiency and implementing commonsense reforms, we can fuel economic growth in our communities
and open the door to the heart of the American dream – homeownership.

Each year, Repair Affair reminds us of the true impact our industry can make, not just
by building homes, but by restoring independence, dignity, and hope. On June 3rd,
dozens of builders, volunteers, and community partners came together for one powerful
purpose: to improve safety and accessibility for those who need it most.
This event falls during the busiest time of year for our members, yet so many paused
their schedules to serve. That willingness to show up, to lend their hands and hearts
speaks volumes about the character of our industry. Their dedication transformed lives,
not in theory, but in real, tangible ways.
Bright green shirts peppered the Sioux Empire as volunteers and builders fanned out
across the region, each one representing a shared mission to make homes safer and
lives more independent. Thanks to their hard work, four projects were completed: two
wheelchair ramps with landings and two home repairs. Each project was more than a
construction task; it was a doorway to greater mobility, confidence, and freedom. For
those living with disabilities or aging in place, these changes are life changing.

Building the Future Together
It’s an honor to serve as President of the South Dakota Home Builders Association this year. For those of you I
haven’t met yet, I’m the owner of Mega Construction in Aberdeen, and like many of you, I’ve built a career rooted in
craftsmanship, hard work, and a love for building homes that strengthen our communities.
One of the areas I’m most passionate about is workforce development. I believe one of our industry’s greatest
challenges and opportunities is attracting and preparing the next generation of skilled professionals. I’ve had the
chance to see this first-hand through events like Build My Future and the SkillsUSA competition at Mitchell Tech. It’s
inspiring to watch students light up when they’re given hands-on experiences in the trades. With continued focus, we
can help close the labor gap and give young people a path to success in a meaningful, high-demand field.
As President, I’ve made it a priority to get out and visit local associations across the state. This spring, I attended the
Brookings and Watertown Home Shows, and the Black Hills Home Show, where I enjoyed connecting with members
and helping with recruitment. I also had the privilege of attending the Black Hills Build PAC social. The energy and
support from members across the region is something special. In April, I joined leaders from around the region at the
Area 10 Regional Meeting, where I served on a workforce panel to discuss the labor challenges contractors are facing
across the state.
In May, I was able to attend the City Bus Tour and Government Night in Sioux Falls. It was a great opportunity to see
the impressive growth across the region and hear directly from community leaders about the future of housing. These
types of events remind us just how important it is for the industry to have a seat at the table in local decision-making.
I also recently participated in a panel discussion at the National Association of Counties conference in Rapid City,
where I was the only contractor on stage. It gave me the chance to speak up about the real challenges we face in
housing development from permitting delays to utility costs and why homebuilding matters in every community.
As I continue my travels and conversations across the state, I’m energized by what I see: dedicated members, passionate
volunteers, and strong leadership at the local level. But to keep our momentum going, we need more people stepping
up in their own communities. I encourage you to get involved with your local HBA, attend events, join a committee,
or invite someone new to be part of what we’re building. When we’re engaged locally, our entire industry grows
stronger. I hope to see you at an upcoming event or connect with you on the road, until then, thank you for all you do

Following the landmark 2023 U.S. Supreme Court ruling
in Sackett v. EPA, which significantly restricted the scope
of wetlands under federal jurisdiction, the South Dakota
Department of Agriculture and Natural Resources (DANR)
has issued new guidance to developers, landowners, and
home builders. The department is offering a grace period as
it works to fill the regulatory gap created by the decision,
ensuring continued protection of South Dakota’s wetlands
while recognizing the practical needs of the construction and
development industries.
In the Sackett decision, the Court ruled that only wetlands
with a continuous surface connection to federally protected
waters—such as rivers, lakes, or streams—can be regulated
by the federal government. This change removed many
isolated wetlands from the jurisdiction of the U.S. Army
Corps of Engineers and the Environmental Protection Agency,
eliminating the requirement for federal permits in those cases.
However, the change in federal oversight does not mean that
developers are free to proceed without scrutiny. Under South
Dakota state law, specifically the South Dakota Water Pollution
Control Act (SDCL § 34A), many of these same wetlands are
still considered “waters of the state.” As such, they remain
protected from pollution and unauthorized fill or discharge
activities, even if they are no longer regulated at the federal
level.
To address the confusion and potential for unintentional
violations, DANR is providing a grace period during which it
will work collaboratively with project owners and developers.
The department is encouraging communication and proactive
engagement rather than immediate enforcement, particularly
for those who take the initiative to report potential issues or
seek guidance before proceeding with development activities.
DANR has outlined several general scenarios to help guide
project teams. For projects where land has been acquired but
planning and design have not yet been completed, developers
are advised to proceed with the same level of caution and
diligence they would have used prior to the Sackett ruling.
This includes obtaining wetland delineations and jurisdictional
determinations through the U.S. Army Corps of Engineers. If
wetlands are present and deemed non-federally jurisdictional,
project owners are strongly encouraged to consult with DANR
before beginning any earth-moving or construction work that
might affect these areas. In many cases, proposed mitigation
measures will need to be reviewed and approved by DANR
before proceeding.
In cases where project design is already completed but
construction has not yet started, the department recommends
that project owners pause to evaluate potential wetland impacts.
DANR is open to working with developers to modify plans or
implement mitigation strategies that minimize or offset those
impacts, and it will review such proposals on a case-by-case
basis during this transitional period.
For projects that are already under construction and may
have unknowingly disturbed wetlands that fall under state
jurisdiction, DANR urges project owners to contact the
department as soon as possible. Self-reporting is viewed
favorably, and the agency will prioritize cooperative resolution
through informal compliance tools when developers come
forward voluntarily. However, if DANR becomes aware of
violations through third-party complaints or site inspections,
it reserves the right to pursue formal enforcement. Under state
law, unauthorized discharges to protected waters can result in
significant penalties, including fines of up to $10,000 per day.
DANR is currently evaluating the creation of a formal state
permitting program to manage dredge and fill activities in non-
federal wetlands. Until such a system is in place, project owners
are encouraged to consult early and often with the department’s
Water Quality Program to ensure that their projects are in
compliance with state law and to avoid unexpected project
delays or legal risks.

At every well-run job site, you’ll find a solid safety plan. It protects your crew, keeps costs in check, and
helps ensure projects stay on schedule. But there’s one critical element that often gets overlooked, mental
health.
As someone who works closely with those in the building and construction industry, I want to gently remind
you: mental health affects everything, from attention and awareness to decision-making and job site
safety. If it’s not part of your safety plan, now is the time to change that.
Mental health struggles can show up in different ways, mood swings, sleep issues, anxiety, substance use,
or even thoughts of suicide. According to a 2020 CDC report, the construction industry has the second-
highest suicide rate among all major U.S. industries. Suicide is a leading cause of death for men between
the ages of 25 and 50. These are our coworkers, our friends, and our family.
Construction work brings unique challenges, physically demanding labor, long hours, common injuries, and
often seasonal layoffs. When you add in financial stress or family challenges, it’s easy to see how someone’s
mental health could suffer. But here’s the good news: there’s something we can do.
By learning to recognize the signs of mental health challenges and knowing how to respond, we can build
safer workplaces and stronger teams. Whether you’re a business owner, crew leader, or HR manager,
having access to the right tools and training can help you support your team before a crisis arises.
At the Helpline Center, we offer free mental health and suicide prevention training designed specifically to
raise awareness, identify warning signs, and empower you with practical ways to help someone in need.
These training courses are a powerful addition to any safety plan and they show your team that you care.
Just like we call 911 in a physical emergency, we now have 988, a nationwide lifeline for mental health,
substance use crises, or suicidal thoughts. Anyone can call, text, or chat 988 to connect with trained
professionals 24/7.

platform for members, industry leaders, and staff to shape the future of housing policy and association
priorities, and this year was no exception.
In June, more than 1,000 builders, remodelers, and industry professionals gathered in Washington,
D.C., to take part in this dual-purpose event, which included national committee meetings, the
NAHB Leadership Council, and the organization’s most impactful day of advocacy: the Legislative
Conference. South Dakota was well represented, with members, delegates, and staff engaging in
direct discussions with Majority Leader John Thune, Senator Mike Rounds, and Congressman Dusty
Johnson to emphasize the importance of pro-housing policies.
During more than 250 meetings on Capitol Hill, NAHB members nationwide focused their message
around three core policy areas critical to addressing the housing affordability crisis:
• Energy Codes & Choice: Advocates urged support for legislation that would block federal
agencies from enforcing costly new energy code requirements and voiced support for the
Energy Choice Act to prevent bans on natural gas both of which would add significant cost
burdens to home construction and reduce consumer options.
• Workforce Development: Members championed the CONSTRUCTS Act and Job Corps
reforms as essential tools to address the construction labor shortage that continues to impact
affordability, project timelines, and business viability.
• Tax Policy: Builders pressed lawmakers to retain and expand key housing tax credits and to
make pro-housing provisions from the Tax Cuts and Jobs Act permanent.
That week also featured impactful insights from national housing leaders, including remarks from
Rep. Mike Flood, Sen. Jacky Rosen, and Rep. Nick Langworthy, among others, all reinforcing the
need to protect housing’s role in our economy and communities.

From policy discussions to economic outlooks to face-to-face meetings with Congress, the Spring Leadership Meeting once
again highlighted why advocacy matters. South Dakota’s delegation played a key role in advancing our industry’s message
and ensuring our voice is heard where it counts most.

At the Leadership Council meeting, Dr. Robert Dietz, NAHB Chief Economist, provided a sobering update on the state
of the housing market. Elevated interest rates, construction costs, and policy uncertainty are contributing to a national
slowdown, with housing starts, builder sentiment, and sales activity all declining. While the U.S. economy remains on solid
footing overall, the housing sector faces real headwinds from labor shortages to tariff impacts to inventory pressure and
NAHB, along with state and local home builder’s associations, continues to advocate for solutions that will support growth
and affordability.

The American Dream has long been rooted in the promise
of homeownership, a place to raise a family, build
memories, and invest in the future. But for those of us in
the homebuilding industry, that dream is more than just an

Builders Association of the Sioux Empire is more important

Our advocacy happens on every level, local, state, and

providing input on state workforce initiatives, or pushing

build is a freedom that cannot be taken for granted.
Behind every meeting, every policy letter, every
conversation with a decision-maker is a commitment to
preserving housing as a cornerstone of opportunity. It’s
about ensuring that our builders can continue to operate,
that our tradespeople have sustainable careers, and that our
communities can grow with intention, not red tape.
But advocacy doesn’t happen in a vacuum. It happens
because members like you make it possible. Your
membership, your involvement, and your voice give this
Association the strength and credibility it needs to fight for
meaningful change.
That’s why we’re calling on you, not just to renew your
membership, but to stand with us. To recognize that the
dues you pay supports more than just networking events or
a listing in a directory. They support the protection of your
business. They help safeguard your future. They fuel our
ability to take action when it matters most.
When we show up, at city council meetings, at the state
Capitol, in D.C., we don’t do it alone. We do it with the
weight of our membership behind us. And the more united
we are, the more powerful our voice becomes.
We need everyone in the industry to be part of this. If you
know someone who’s not involved, invite them to join us.
Bring them to the next event. Introduce them to the work
we’re doing. The more people we bring to the table, the
louder our voice and the greater our impact.
Membership in this Association isn’t passive, it’s a
partnership. And right now, we need every member engaged,

The future of our industry will be shaped by the actions we

Honoring Craftsmanship and Commitment
The evening also provided an opportunity to celebrate the builders who brought the Spring Parade of Homes to life. Among
them were this year’s Feature Home builders: Smart Homes and Krumvieda Companies, whose homes exemplified
exceptional craftsmanship, thoughtful design, and innovation. Their work and the work of all Parade participants helped
showcase the incredible talent and dedication found throughout our membership. Thank you to every builder who
contributed to this year’s event and helped shine a light on the strength of our local industry.
We also took time to recognize the value and longevity that membership brings to our Association. It’s the ongoing
engagement of our members that fuels our mission, strengthens our voice, and keeps our industry moving forward. That
commitment was exemplified by two companies honored for 30 years of continuous membership:

We extend our heartfelt appreciation to these longtime members for their dedication to the Association, to the industry,

Supporting the Next Generation
This year, we also celebrated futures through education, recognizing 12 high
school graduates who received scholarships through the Sioux Empire Home
Builders Care Foundation. A total of $12,000 was awarded to students pursuing
careers in the building industry. The Foundation has awarded over $116,950 to
high school graduates and more than $180,000 to partner colleges, bringing the
total to nearly $300,000 in scholarship support. This investment in education
helps ensure the future of our workforce remains strong and skilled.
A Message from NAHB Leadership
The evening concluded with a keynote address by Carl Harris, Immediate Past Chairman of the National Association
of Home Builders. A long-time builder from Kansas and a passionate industry advocate, Carl brought a message that
reflected the very theme of the night: the power of partnership between generations, communities, and every level of
leadership. Known for his honest insights, engaging presence, and just the right touch of humor, Carl reminded us that
our collective voice is what fuels the future of housing. His message was a powerful close to an evening that truly
embodied connection, collaboration, and momentum for our industry.

City Bus Tour & Government Night
Celebrating Growth, Leadership, and Connection
The City Bus Tour and Government Night came together as a powerful one-day experience
that blended education, celebration, and connection for HBASE members. These signature
events highlighted the strength of our industry, the importance of staying informed, and the
value of engaging with community leaders and peers.
Local Leaders Talk Growth and Challenges
That evening, Government Night welcomed
members to a dynamic gathering centered on
leadership, industry insight, and recognition. The
program began with a forward-looking discussion
on growth and opportunity featuring Mayor Harry
Buck (Brandon), Mayor Arden Jones (Hartford),
Mayor Glenda Vinson (Salem), and Heath
VonEye (Harrisburg Deputy City Administrator).
Moderated by Joel Ingle, the conversation explored
population trends, housing permits, infrastructure
challenges, and the importance of partnerships
between city leaders and the homebuilding
industry. Panelists shared both opportunities and
obstacles their communities face and emphasized
the need for continued collaboration to sustain
healthy, smart growth.
Touring the Region’s Growth Corridors
The day began with the ever-popular City Bus Tour, offering members a firsthand look at the rapid growth and development
taking place across the Sioux Empire. The route included key stops through northern Sioux Falls, Dell Rapids, Crooks,
and Hartford. These areas are shaping the future of our region in meaningful ways. For many attendees, it was a chance
to explore communities they don’t often get to visit, gaining a fresh perspective on the opportunities and development
trends emerging beyond the Sioux Falls city core.
Guided by local representatives, participants heard directly from community leaders about new housing developments,
infrastructure improvements, and long-term growth plans. The tour brought to life the energy and vision behind our
expanding region and underscored the critical role our members play in making that growth possible.
